As a condition of using the OurCellar website at ourcellar.com.au (referred to as the 'website " or "site" unless otherwise specified) you agree to comply with and be subject to all of the following terms of use, including our Privacy Policy. This agreement is between you (the “user”) and OurCellar.com.au

By registering your details and entering your date of birth in the compulsory fields on the ourcellar.com.au website, you represent and warrant to OurCellar that you are at least 18 years of age and are therefore of legal age to purchase alcohol. OurCellar supports the Responsible Service of Alcohol. New South Wales Liquor Act 2007. It is an offence to sell or supply alcohol to, or obtain on behalf of a person under the age of 18. Proof of age may be requested upon receipt of alcohol deliveries. Packaged Liquor Licence. Licence Number LIQP770016415.

Delivery

For further details regarding our delivery service, including timeframes and areas, please read our delivery information. Please note that delivery timeframes provided are our best estimate of when your order will get to you and may vary due to circumstances beyond our control. We endeavour to deliver orders as close to the estimated timeframe as possible but we cannot guarantee this.

Products can only be delivered to the person named on the order or a person who is at the address provided that person is over the age of 18. In each case, the person taking delivery may be required to provide proof of identity (including photographic identification and date of birth). If your delivery address is in South Australia or the Northern Territory, you may also be required to provide your signature at the time of delivery.

OurCellar provides you the option to select ‘Authority To Leave’, also known as ‘Safe Drop’, at the checkout. If you have selected this option, your order will be left in a safe place as described in the Authority To Leave options in the OurCellar checkout.

If you have requested a safe drop location that our Australia Post or another delivery partner reasonably believes is unsuitable, they may choose not to leave it and it will be taken to a Post Office to be collected and you will be notified. You can read more about Authority To Leave or Safe Drop on the Australia Post website.

Please note that Authority To Leave requirements differ from state to state. We recommend creating an account with us so that your age can be verified and saved to support using ATL options in certain states.

If you are placing an order as a gift for another person the gift recipient must be over the age of 18, and we are required by law to instruct the person delivering the order that the liquor must only be delivered to the recipient or to another person who is over 18 years and present at the address provided. The recipient must provide an acceptable form of identification to verify their age. You agree that we may rely on any person who is at the address you gave for delivery, and who takes receipt of your ordered products, as being authorised for that purpose.

Your order may not be delivered if there is reason to believe the delivery circumstances are unsuitable, including:

  • If there is reasonable belief that the order recipient is intoxicated
  • If there is reasonable belief that an adult is purchasing alcohol on behalf of a minor or will supply alcohol to a minor
  • If the order recipient is under the age of 18 or they fail to provide a valid proof of age
  • You have requested the delivery to be left in an unsuitable or unsafe location

Product images & prices

While every attempt is made to ensure the integrity of products, product availability, images, labels, closure types, vintages (where specified) and pricing is correct, there may be instances where incorrect information is inadvertently advertised or displayed whether on our own website or through a third party website such as a price comparison websites etc. As soon as such an error has been identified, ourcellar will rectify this error as quickly as possible. Information is also subject to change without notice (including vintages and label changes), therefore no warranties, either expressed or implied, are provided by OurCellar. All prices advertised on ourcellar.com.au include GST and are shown separately on order confirmations and invoices.

Product availability

In the case of an order being received and product is then found to be unavailable, OurCellar will either:

    1. Contact you and offer you a replacement product at a similar price and quality or,
    2. Offer you a full refund.

In the case of an incorrect price being advertised or an incorrect image being displayed (including vintage), OurCellar may decline or cancel any orders placed. If your credit card was charged and the order was cancelled by us, you will be notified by a member of our customer service team and a refund will be issued to your credit card or PayPal account.

Vintages

While every effort is made by OurCellar to ensure vintage information is current, vintages of products change regularly and often without notice. In the case where an order is received by you and the vintage is different to that displayed either in text or a vintage displayed on a bottle image, OurCellar will make every effort to rectify that but if a previous vintage is no longer available, OurCellar can not offer a refund.

Loss or damage

Responsibility of any damage, loss and breakage to any product passes to the buyer upon delivery (as verified by the 'Proof of Delivery' documentation supplied to us by our nominated shipper), therefore a refund will not be offered for a product, or products damaged after receipt of delivery.  In the case where the 'Authority to Leave' option is chosen by you during the checkout process, OurCellar will not take responsibility and offers no warranties for loss or damage which may occur whether by theft or breakage.

Quantity purchases

There are no minimums or maximums (unless specified) at OurCellar, so you can order from one to a hundred to get the best price at ourcellar.com.au. If your order is a large one, feel free to contact us via info@ourcellar.com.au as we may be able to offer you a better deal on quantity purchases and or shipping costs.

High value and suspicious orders

Due to credit card fraud attempts, payment for some high value sales will only be accepted via direct bank transfer into our nominated bank account.

If we receive an order which meets this criteria, and payment has already been made via credit card, OurCellar will refund the order back to your credit card and advise you of our preferred payment method which is either payment via a verified PayPal account or via direct bank transfer.

If agreed by you, we will then advise you of our bank account details. Once your payment has been received into our nominated bank account, your order will be dispatched immediately.
